  • terms
  1. Subscriptions
    1. A subscription is made online, through the portugal123.net platform.
    2. A subscription of any service plans confirms the acceptance of the terms and license agreement expressed here.
  2. domain & hosting
    1. The system will remain hosted on the same server where portugal123.net is located.
    2. The client can use the personalized system at a specific portugal123.net address (ex: yourcompany.portugal123.net).
  3. payments
    1. All payments or renewals of payments are made considering the annual cycle of 365 days.
    2. The calculation unit is the month.
    3. Subscriptions renewals can be made at any time. Add-on system.
    4. Failure to renew the service will result in the suspension of the account and respective subscribed service.
    5. Late renewal of services has an additional cost of 50.00€.
    6. VAT at the legal rate applicable shall be added to all values presented in this document.
  4. NON-RENEWAL, WITHDRAWAL or CANCELLATION
    1. All subscriptions may be cancelled at the end of each annual cycle.
    2. By cancelling a subscription, some functionalities, data structures and respective data which, by virtue of being communicated to the SEF, may not be eliminated or disabled.
  5. subscription suspension, non payment
    1. Subscriptions are made available immediately. If there is no payment confirmation within 24 hours, the subscription will be suspended.
  6. technical support
    1. technical support is given via a ticket system, available at portugal123.net.
  • Software License Agreement
  1. General
    1. This is an agreement between Licensor and Licensee, who is being licensed to use the portugal123.net app, referred further on as the Software.
    2. Licensee acknowledges that this is only a limited nonexclusive license. Licensor is and remains the owner of all titles, rights, and interests in the Software.
    3. This License permits Licensee to run the Software on more than one computer system, as long as the Software will not be used on more than one computer system simultaneously. Licensee will not make copies of the Software or allow copies of the Software to be made by others, unless authorized by this License Agreement. Licensee may make copies of the Software for backup purposes only.
  2. warranty
    1. This Software is subject to a limited warranty. Licensor warrants to Licensee that the Software will perform according to its printed documentation, and to the best of Licensor's knowledge. Licensee's use of this Software according to the printed documentation is not an infringement of any third party's intellectual property rights. This limited warranty lasts for a period of 365 days after subscribing/subscription renewal.
    2. To the extent permitted by law, THE ABOVE-STATED LIMITED WARRANTY REPLACES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AND LICENSOR DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING ANY IMPLIED WARRANTY OF TITLE, MERCHANTABILITY, NONINFRINGEMENT, OR OF FITNESS FOR A PARTICULAR PURPOSE.
    3. No agent of Licensor is authorized to make any other warranties or to modify this limited warranty. Any action for breach of this limited warranty must be commenced within one year of the expiration of the warranty.
    4. The LICENSOR IS NOT LIABLE TO LICENSEE FOR ANY DAMAGES, INCLUDING COMPENSATORY, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, CONNECTED WITH OR RESULTING FROM THIS LICENSE AGREEMENT OR LICENSEE'S USE OF THE SOFTWARE. Licensee's jurisdiction may not allow such a limitation of damages, so this limitation may not apply.
  3. liability and validity
    1. Licensor has the right to terminate this License Agreement and Licensee's right to use the Software upon any material breach by Licensee.
    2. This License Agreement is the entire and exclusive agreement between Licensor and Licensee regarding the Software. This License Agreement replaces and supersedes all prior negotiations, dealings, and agreements between Licensor and Licensee regarding the Software.
    3. This License Agreement is valid without Licensor's signature. It becomes effective upon the earlier of Licensee's signature or Licensee's use of the Software.
